Abstract

ABSTRACT Partnership and Cooperation Agreement (PCA) antara Indonesia dengan Uni Eropa (UE) telah ditandatangani pada tanggal 9 November 2009 oleh Menteri Luar Negeri RI dan Menteri Luar Negeri Swedia (selaku presidensi UE). Struktur perjanjian ini terdiri atas 7 Bab dan 50 Pasal yang mencakup kerjasama di berbagai bidang hak asasi manusia dan demokrasi. Penelitian ini bertujuan untuk mengetahui peran Partnership and Cooperation Agreement dalam mendorong nilai demokrasi dan penegakan hak asasi manusia (2007-2014). Penelitian ini menggunakan metode penelitian kualitatif deskriptif, yaitu jenis penelitian yang digunakan untuk menjelaskan fenomena secara deskriptif. Pengumpulan data dalam penelitian ini mempergunakan teknik studi kepustakaan yang menggunakan sumber data dari literatur, jurnal, artikel-artikel, majalah, surat kabar, dan situs internet. Hasil penelitian menunjukkan bahwa: pertama, PCA memiliki peran mengembangkan dialog berkelanjutan tentang Hak Asasi Manusia (HAM) dan demokrasi. Isu-isu tentang HAM dan demokrasi di Indonesia selalu menjadi bahan pembicaraan dalam dialog tahunan, namun pembicaraan lebih menitikberatkan pada masalah HAM dan demokrasi di Indonesia. PCA menjadi landasan kerja sama dalam melakukan kontrol terhadap penegakan HAM dan demokrasi melalui European Instrument for Democracy and Human Rights (EIDHR)melakukan kerjasama dengan LSM dan lembaga-lembaga non pemerintah ataupun lembaga pemerintah dalam menegakkan HAM dan demokrasi. Kedua, Kerjasama UE dan Indonesia dalam kerangka PCA berimplikasi pada penegakan hukum dan HAM berlangsung lebih konstruktif. Kata Kunci: PCA, HAM dan Demokrasi. ABSTRACT Partnership and Cooperation Agreement (PCA) between Indonesia and the European Union (EU) was signed on 09 November 2009 by the Minister of Foreign Affairs and Minister of Foreign Affairs of Sweden (as the EU presidency). The structure of this agreement consists of 7 chapters and 50 Articles that cover cooperation in various fields of human rights and democracy. This study aims to determine the role of the Partnership and Cooperation Agreement to promote the values of democracy and human rights (2007-2014). This study uses descriptive qualitative research method, which is a type of research that is used to describe the phenomenon descriptively. Collecting data in this study using literature study techniques that use data sources from literature, journals, articles, magazines, newspapers, and Internet sites. The results showed that: first, the PCA has the role of developing sustainable dialogue on Human Rights (HAM) and democracy. The issues of human rights and democracy in Indonesia has always been a matter of discussion in the annual dialogue, but the conversation is more focused on issues of human rights and democracy in Indonesia. PCA is a basis for cooperation to control the enforcement of human rights and democracy through the European Instrument for Democracy and Human Rights (EIDHR) in cooperation with NGOs and non-governmental organizations or government agencies in upholding human rights and democracy. Secondly, the EU and Indonesia Cooperation within the framework of PCA have implications on human rights and law enforcement lasted more constructive. Keywords: PCA, Human Rights and Democracy.
