Abstract
Penelitian ini bertujuan untuk mengetahui faktor-faktor yang menghambat APSC dalam penanggulangan terorisme khususnya daerah Indonesia. Penelitian ini termasuk jenis penelitian analisis data dekriptif dengan mengacu kepada pendapat K.J. Holsti. Kendala atau faktor penghambat yang diteliti bermula pada tingkat internasional yaitu prinsip ASEAN WAY, dimana pada aspek non-intervensi. Aspek tersebut bisa sangat membantu tetapi juga sangat menghambat dalam penanggulangan teroris yang sudah berkembang jaringannya menjadi kejahatan lintas negara. Ketidakharmonisan sistem hukum dan juga belum adanya perjanjian ekstradisi sangat menghambat implementasi APSC tentang penanggulangan terorisme. Adapun pada tingkat domestik yaitu kurang jelasnya sistem hukum dan juga peraturan yang mengatur tentang tindak pidana terorisme. iii ABSTRACT This research aims to determine the factors cause the difficulty of implementation on APSC to combating terrorism, especially the goverment of Indonesia. This research includes descriptive data analysis research by referring to the opinion of K.J. Holsti. Obstacles or inhibiting factors studied began at the international level, namely the principle of ASEAN WAY, where the aspect of nonintervention. These aspects can be very helpful but also very inhibiting in combating terrorist network has evolved into a transnational crime. Disharmony legal system and also the absence of an extradition treaty greatly hinder the implementation of the APSC on counter-terrorism. As at the domestic level, namely lack of clarity of the legal system and regulations governing criminal act of terrorism.
