Abstract
Abstrak Penelitian ini adalah mengenai latar belakang pembentukan Resolusi Majelis Umum PBB tentang Hak Privasi Dalam Era Digital, yang sebelumnya terjadi pengungkapan informasi tentang adanya kasus penyadapan yang dilakukan aliansi “Five Eyes” yang menimpa beberapa negara. Penyadapan ini dianggap melanggar hak asasi manusia dan bertentangan dengan norma-norma hukum internasional yang telah ada seperti misalnya prinsip masyarakat yang demokratis. Atas dasar pengungkapan informasi tentang adanya kasus-kasus penyadapan tersebut, negara-negara yang menjadi korban penyadapan yang dipelopori oleh Jerman dan Brasil kemudian mengajukan laporan kepada Majelis Umum mengenai permasalahan ini. Hasil dari pelaporan ini adalah ditetapkannya sebuah resolusi pada sidang Majelis Umum yang ke 68 pada 18 Desember 2013, yaitu resolusi mengenai hak privasi dalam era digital yang diharapkan dapat menjamin perlindungan bagi individu dalam hal offline maupun online. Abstract This study is about the background of the General Assembly of United Nations Resolution making about The Right to Privacy in the Digital Age, which there were any leaking informations about global surveillance programs to the several countries by the “Five Eyes” has revealed. This programs may be contrary to the human rights and the principal of democratic society. Based on disclosures of surveillance programs, Germany and Brazil which the pioneer of the victims countries have proposed the report to the General Assembly about the problem. The results of the report is the the resolution that legalized by the sixty-eigth meeting session of the General Assembly in 18 December 2013. The resolution called The Right to Privacy in the Digital Age which expectly can be regulates the protections of people by the “offline” and also “online”.
