Abstract
Thirty-five years have passed since the United Nations Convention on the Rights
of the Children (UNCRC) was introduced at the UN General Assembly in 1989,
but the effectiveness of the global regime is still in question. On the one hand,
this convention is regarded as critical for the creation a safer, more peaceful,
and afluent world for future generation. But, on the other hand, children
continue to experience situations that are far from safe, quiet, or prosperous.
The implementation of the rights of the child, as stated in the opening sentence
of the UNCRC, is part of the recognition that every living being—including
children—is entitled to all equal rights and freedoms, regardless of race, gender,
language, religion, ideology, national origin, or socioeconomic status. This
article attempts to explore the extent to which UNCRC can be applied, and what
its limitations are. Using Palestine as a case study, this article finds that the
practice of implementing the UNCRC is still coloured by segregation that is
political and racists in nature. This article concludes with a proposal on the need
of taking critical approach while evaluating the implementation of global
norms such as children's rights and human rights.
